1. About FocusEdu

FocusEdu Pty Ltd (FocusEdu, we, us) operates FocusEdu.com.au (the Platform), a personalised exam preparation service for children in Years 3–6 preparing for NSW Opportunity Class (OC) and Selective High School Placement Tests.

By creating an account or using the Platform, you agree to these Terms of Service (Terms). Please read them carefully. If you do not agree, do not use the Platform.

2. Service Description

FocusEdu provides:

  • Adaptive diagnostic tests that identify skill gaps in Mathematical Reasoning and Thinking Skills.
  • Daily personalised practice sessions targeting each student's specific weaknesses.
  • Skill mastery tracking, cycle-based learning reports, and parent dashboards.
  • One linked student profile per parent account.

FocusEdu is an educational preparation tool. We do not guarantee admission to any school or programme. Success in OC or Selective placement depends on many factors beyond any single preparation platform.

3. Eligibility and Account Creation

To use FocusEdu, you must be at least 18 years of age. Student accounts are created and managed by a parent or legal guardian, who takes full responsibility for the student's use of the Platform.

By creating a student account, you confirm that you are the parent or legal guardian of the child and that you consent to the collection and use of the child's learning data as described in our Privacy Policy.

Each parent account may manage at most one linked student profile. If your family needs support for another student, a separate parent account and subscription are required.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable Use

You agree not to:

  • Share your account credentials with others or use FocusEdu for commercial tutoring or resale without our written permission.
  • Attempt to reverse-engineer, copy, or redistribute any FocusEdu content, questions, or algorithms.
  • Upload any content that is illegal, harmful, or infringes third-party intellectual property rights.
  • Use automated tools to scrape, harvest, or extract content from the Platform.
  • Interfere with or disrupt the security or integrity of the Platform.

5. Subscription and Billing

FocusEdu offers a subscription plan billed weekly in Australian Dollars (AUD), inclusive of any applicable GST. AUD $29 per week covers one student. Current pricing is published on our Pricing page.

Payments are processed by Stripe. By subscribing, you authorise Stripe to charge your nominated payment method on a recurring basis until you cancel.

Weekly billing: Subscriptions are billed at AUD $29 per week, charged every 7 days from the date of your first payment. Access to the platform is conditional on an active subscription. FocusEdu does not currently offer a free trial.

Cancellation: You may cancel your subscription at any time from the billing settings in your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access until that date. We do not provide partial refunds for unused days in a billing period, except where required by Australian Consumer Law.

We reserve the right to change subscription pricing with at least 30 days' notice to existing subscribers.

6. Intellectual Property

All content on the Platform — including questions, explanations, reports, software, and design — is owned by FocusEdu Pty Ltd or its licensors and is protected by Australian copyright law. You may not reproduce, distribute, or create derivative works from Platform content without our prior written consent.

Your student's learning data remains your property. You grant us a limited licence to process that data solely to provide the service.

7. Disclaimer of Warranties

To the extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or that any particular outcome will be achieved.

Nothing in these Terms excludes any guarantee or warranty implied by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

8. Limitation of Liability

To the maximum extent permitted by law, FocusEdu's total liability to you for any claim arising from or related to these Terms or the Platform is limited to the amount you paid us in the three months preceding the claim.

We are not liable for any indirect, incidental, special, or consequential loss, including loss of data, loss of opportunity, or loss of profits, even if we have been advised of the possibility of such loss.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will provide at least 14 days' notice by email or via a notice on the Platform before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Platform ceases immediately. Clauses relating to intellectual property, limitation of liability, and governing law survive termination.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising from or related to these Terms or the Platform.
